Personal Injury
Duncan Garnett offers an extensive range of legal services to those who have been injured as a result of another’s negligence. Over the past several decades, our firm has handled a countless number of cases ranging from car accident lawsuits to defective product claims. Regardless of the area in which we practice, the Virginia accident attorneys at our firm have the same overall goal, which is to obtain the highest amount of compensation for both those who have been seriously harmed and the loved ones of those who have been fatally injured.
Medical Malpractice
Under Virginia medical malpractice law, injured patients may have a claim to seek compensation if they were physically harmed by the negligence of a doctor, nurse or other medical professional or facility. A medical error or poor outcome does not necessarily mean that the injured patient has a valid medical malpractice claim. However, when a doctor or other medical professional acts unreasonably, or beneath the level of care expected in the medical community, the victim may have legal recourse to seek compensation for medical bills, lost wages and other damages. Duncan Garnett offers a free, no obligation case review to help these individuals determine whether they have legal recourse to seek compensation for monetary damages.
Tractor Trailer Accidents
Truck accident lawsuits generally present a unique set of issues, which may include complications with the trucking company, insurance company or legal representation for the defendant. Therefore, drivers and passengers who have been injured in a Virginia trucking accident should seek legal assistance from an attorney well-versed in this area of law. Duncan Garnett has a successful track record handling catastrophic injury cases, as well as a thorough understanding of the complexities of truck accident law.
Auto Accident
Car accidents in Newport News and the Hampton Roads region can leave their victims with serious and often debilitating injuries. Brain injuries, neck injuries and paralysis are among the catastrophic injuries which can develop in individuals who have been involved in a car crash. Often times, following an auto accident, these injuries can leave the victim questioning how they will pay for medical bills, support a family and maintain financial stability while needing time away from work to heal. Duncan Garnett will help you determine liability for your auto accident, and work with medical and economic experts to determine necessary compensation.
Product Liability
In Virginia, when a person is killed as a consequence of another’s negligence or misconduct, the victim’s dependants may be able to file a wrongful death lawsuit to recover damages from the party negligent in causing their loved one’s death. Under Virginia wrongful death law, surviving relatives (or, distributees) who may be eligible for damages include spouses, children of the deceased, and in some cases, grandchildren of the deceased.
These individuals could be entitled to Virginia wrongful death damages including compensation for funeral costs; treatment and care costs; sorrow, mental anguish and solace costs; expected loss of income and services costs; punitive damages; as well as other damages the court may see fit.
Product liability is the area of law in which manufacturers, distributors, suppliers, retailers, and others who make products available to the public are held responsible for the injuries those products cause. Product liability comes in three types: design defect, manufacturing defect, and the failure to warn consumers of defects. When a malfunctioning or defective product contributes to the death of an individual, the victim’s relatives may be able to file a wrongful death claim in Virginia.

Our case regarding the death of our son was very complex with a lot of obfuscation by the people involved and some very challenging legal issues. However, when we first met with Duncan, we told him that we had two objectives: 1) to establish that our son was not driving the vehicle that night, and 2) to find out as much as was possible about what actually happened that night. Both objectives were achieved, and it took considerable effort on Duncan’s part to get that done. We are glad we engaged Duncan Garnett’s services.
